Terms of service

These terms govern your use of Airea, a marketing and operations platform for real estate agents operated by Above the Fold in Aotearoa New Zealand ("Airea", "we", "us"). By creating an account or using the service, you agree to these terms.

Your account

You must provide accurate details, keep your login secure, and be responsible for activity under your account. Airea's self-serve plans are for an individual agent's own use; you may not share a single login between multiple people.

Plans, trial and billing

• New accounts start with a free trial. After the trial, continued use requires a paid subscription.
• Agent Plus is $29.95 per month and Agent Pro is $49.95 per month (NZD, per agent). Agent Pro additionally lets you place a second agent on your graphics and designs.
• Subscriptions are billed monthly in advance through Stripe and renew automatically until cancelled. You can change or cancel your plan at any time from your account; cancellation takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable. Prices may change on reasonable notice.

Your content and responsibilities

• You retain ownership of the listing details, images and other content you bring into Airea. You grant us the limited rights needed to store and process that content to provide the service.
• You are responsible for ensuring you have the right to use the content you upload or import — including listing photos, and the name and image of any second agent you add to a design — and that your use complies with the terms of the sources you draw from (such as realestate.co.nz).
• You must not use Airea for unlawful, misleading or infringing purposes, or in a way that harms the service or other users.

Intellectual property

Airea, including its software, templates and design system, is owned by Above the Fold and protected by law. These terms do not transfer any of our intellectual property to you beyond the right to use the service while your subscription is active.

Third-party sources and services

Airea integrates with third parties such as realestate.co.nz (for public listing data) and Stripe (for payments). Your use of those services may be subject to their own terms, and we are not responsible for their content or availability.

Availability and disclaimers

We work hard to keep Airea available and accurate, but the service is provided "as is" without warranties of any kind. We do not guarantee that outputs will be error-free or that the service will be uninterrupted. Nothing in these terms limits rights you may have under the New Zealand Consumer Guarantees Act 1993 where it applies.

Limitation of liability

To the extent permitted by law, Airea and Above the Fold are not liable for indirect or consequential loss, and our total liability arising from the service is limited to the amount you paid us in the three months before the event giving rise to the claim.

Termination

You can stop using Airea and close your account at any time. We may suspend or terminate access if you breach these terms or to protect the service. On termination, your right to use the service ends; we may delete your data in line with our privacy policy.

Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute.

Changes

We may update these terms from time to time. We will revise the "last updated" date above and, for material changes, let you know within the app or by email. Continued use after a change means you accept the updated terms.
